Dream Laps – Liability Waiver & Release

This Liability Waiver & Release Agreement (“Agreement”) is entered into between Dream Laps LLC (“Dream Laps,” “we,” “our”) and the undersigned participant (“Participant,” “I,” “me”). This Agreement applies to all persons participating in any Dream Laps experience, including:

• Drivers

• Ride-along passengers (hot laps)

• Minors (with guardian)

• Spectators within restricted areas

By signing, I acknowledge that I have read, understood, and agreed to this Agreement.

1. Acknowledgment of Inherent Risk

I understand that participating in or observing high-performance driving activities involves significant, inherent, and unavoidable risks, including but not limited to:

• Loss of vehicle control

• Collision with other vehicles or barriers

• Mechanical failure

• Rapid acceleration, deceleration, and high G-forces

• Exposure to debris or environmental hazards

• Fire or explosion

• Serious injury, paralysis, or death

• Exposure to communicable diseases (including but not limited to COVID-19)

These risks exist even when all safety precautions are taken.

2. Assumption of Risk

I voluntarily assume full responsibility for all risks, known or unknown, associated with:

• Driving high-performance or race-prepared vehicles

• Riding as a passenger during hot-lap experiences

• Being present in pit lane, spectator zones, or track-adjacent areas

I understand and accept that these activities involve dangers that cannot be completely eliminated.

3. Ride-Along / Hot Lap Passenger Acknowledgment

If participating as a ride-along passenger, I further acknowledge:

• I will experience rapid acceleration, high G-force cornering, and sudden braking

• I have no control over vehicle operation

• I may experience physical effects including nausea, strain, or discomfort

• I must keep hands, arms, feet, and equipment secure at all times

I voluntarily choose to participate despite these risks.

4. Release of Liability & Waiver of Claims

To the fullest extent permitted by law, I hereby release, waive, and discharge Dream Laps LLC, its owners, employees, instructors, independent contractors, track partners, sponsors, and affiliates from any and all claims, demands, actions, or causes of action arising out of ordinary negligence on the part of Dream Laps.

This release includes, but is not limited to:

• Personal injury, death, or property damage

• Participation as a driver or passenger

• Presence in restricted areas

• Vehicle substitution or mechanical failure

• Exposure to communicable diseases

This waiver does not apply to claims arising from gross negligence or intentional misconduct.

This release applies to both drivers and passengers.

5. Covenant Not to Sue

I agree that I will not file or assist in filing any lawsuit, claim, or legal action against Dream Laps for any injury, loss, or damage arising from participation in this activity, except in cases of gross negligence or intentional harm.

6. Indemnification

I agree to indemnify and hold harmless Dream Laps from any claims, demands, or legal actions brought by third parties as a result of:

• My actions or conduct

• My failure to comply with safety rules or staff instructions

• Damage or injury I cause to others

This includes attorney fees, legal costs, and damages.

7. Vehicle Damage Responsibility (Drivers Only)

I acknowledge that I am financially responsible for any damage I cause to Dream Laps vehicles or property due to negligence, misuse, or failure to follow instructor guidance.

A security hold of $5,000 will be placed before participation:

I authorize Dream Laps to charge repair costs up to this amount, or full cost if damages exceed the hold.

Reckless Driving Surcharge

Each reckless action or off-track excursion incurs a $1,000 surcharge, in addition to repair costs. Ride-along passengers are not responsible for vehicle damage.

8. Medical Fitness & Responsibility

I certify that:

• I am in good physical and mental condition

• I am not pregnant

• I do not have a heart condition, high blood pressure, motion sickness sensitivity, seizure disorder, neck or back issue, or other condition that may be aggravated by high-speed driving

• I have no prosthetic, medical device, or mobility limitation that poses risk during high G-force activity

• I am not under the influence of alcohol, drugs, or impairing medication

I agree to notify Dream Laps of any medical concerns prior to participation.

Dream Laps may refuse participation if I appear unfit for the activity.

9. Safety Compliance

I agree to:

• Follow all instructions from instructors and staff

• Attend all mandatory briefings

• Wear required safety gear (helmets, seatbelts, etc.)

• Abide by all track rules and flag signals

Dream Laps reserves the right to stop my session at any time for unsafe behavior.

10. Binding Arbitration & Waiver of Jury Trial

Any dispute arising from this agreement shall be resolved by binding arbitration in the State of Tennessee under the rules of the American Arbitration Association.
I expressly waive my right to a trial by jury.

11. Media Release (Optional)

I ☐ agree / ☐ do not agree to allow Dream Laps to use photos or videos of my participation for promotional purposes.

12. Legal Enforceability

This agreement is binding on me, my heirs, executors, administrators, and assigns.
If any part of this agreement is found unenforceable, the remaining sections shall remain in effect.

13. Acknowledgment of Contractual Nature

I understand and agree that:

• This waiver is a binding legal contract

• I am signing voluntarily and of my own free will

• I have the right to consult an attorney before signing

• I sign this Agreement as a condition of participation
